母子沒戴安全帽 遭取締暴粗口 罪加一等

新北市一對母子日前騎車雙載，因為沒有配戴安全帽被警方取締。母子兩人竟對員警暴粗口，涉嫌觸犯妨害公務罪，遭到法辦。台北地院審理後，認定母子兩人觸法，分別判處兩人拘役二十天，緩刑兩年。

判決書指出，二十歲的羅姓男子去年九月底騎乘機車搭載母親行經新北市新店區北新路與中華路口時，因為沒配戴安全帽遭警方攔查，還被查出他無照駕駛依法開單告發。母子兩人竟心生不滿，分別對取締員警大飆三字經，罪加一等，被依照妨害公務罪偵辦。

台北地院審理時，母子辯稱兩人都患有重度憂鬱症才容易情緒失控，並提出身心障礙手冊佐證。法院調查後，認為兩人對案發過程能具體陳述，還能抗辯是口頭禪或一時緊張，顯見當時的精神狀態並沒有因精神障礙無法辨識行為違法，認定觸犯辱罵公務員罪，審酌他們罹患精神疾病，缺乏情緒管控，以粗言穢語辱罵員警，漠視國家公務執行，但兩人犯後態度尚可，所以分別判處拘役二十天，可易科罰金，並宣告緩刑兩年，以啟自新。全案可上訴。
