法拍凶宅 司法院：法院有責先查明

想買法拍屋怕買到凶宅，司法院特別為此修法，要求法院跟鑑定人有責任向屋主或債務人查詢房子有無問題，必加以記載、公告，讓法拍資訊更透明。如果屋主不配合或虛偽陳述，還可加以管收。

台南一名單親媽媽買法拍屋卻買到凶宅，銀行不給貸款被迫放棄，引發社會關注。司法院認為，各法院在辦理法拍屋時，有責任先查明房子有無問題，所以迅速完成法令修正，祭出三大解決方案。

司法院民事廳法官王漢章說，第一、法院查封房子時，在現場應調查有無問題，第二、一經查明就要在筆錄載明，同時在拍賣公告記載清楚，提醒應買人注意，如果沒有載明將可依法撤銷拍賣。

第三、司法院也要求不動產鑑定人鑑價時，必須再調查一次房子有無非自然死亡、輻射屋、海砂屋、火災受損等足以影響交易的特殊情形。而且司法院還提供範本，讓調查人員可照例稿做調查並加以勾選，然後將最終的調查結果記載在公告裡，層層把關防守，提升房屋拍賣資訊的透明度。
