結夥搶表親 男判賠近六百萬

（中央社記者陳淑芬台中25日電）江姓男子覬覦劉姓表兄弟財力，夥同何姓男子等人出面行搶。劉家提出民事求償財損及精神撫慰金，台中地院判賠580萬元。

根據台中地方法院今天公布的判決書，江男與劉姓表兄弟曾合夥做生意，關係互動良好，兩人拆夥後，劉男生意越做越好，但江男經濟狀況卻不順利。

江男覬覦劉男財力雄厚，因劉男常在中國大陸經商，位於台中的住家僅有年邁父親及待產的妻子，即夥同親戚共謀強盜，由江男提供劉家生活作息及室內擺設等情資，並另外找到何姓男子等人同夥行搶。

去年4月間，何男等3人夜間持開山刀及玩具槍等器械，先假冒快遞人員潛入劉家社區，再持槍械壓制劉父及劉妻侵入劉家，搶走財物，連固定在地面的保險箱都以器械撬走，逃逸分贓。

刑事的部分，江姓男子等人各被判刑10年至2年不等定讞。劉男及家人提出刑事附帶民事訴訟，請求江男等人連帶賠償，包括財物損失新台幣500萬元及精神撫慰金300萬元，總共800萬元賠償金。

台中地院判處洪男等6人對劉男及家人，除賠償財物損失500萬元外，須再賠償精神撫慰金80萬元，共580萬元。全案可上訴。1020925
