租屋跳樓成凶宅 房東求償敗訴

（中央社記者蔡沛琪台北25日電）孫男重病纏身而在租屋處跳樓身亡，房東不滿房屋成凶宅，提告向死者家屬求償。二審法院認為家屬對損失發生無故意，判決免賠。

根據法院今天公布判決，孫男夫婦從民國99年3月在新北市板橋區簽約租屋，孫男重病纏身而萌發輕生念頭，留下遺書後在100年7月跳樓身亡。

房東不滿房屋成了凶宅，認為房價腰斬，提起民事訴訟，求償新台幣160萬元。一審判決房東敗訴，他不服而提起上訴。孫男家屬說，無從預防或防範自殺，死者當時是在醫院往生，房屋不算凶宅，房東未因此受有損害。

台灣高等法院認為，自殺事件未造成房屋毀損滅失或功能損壞，所有權未受損害。況且死者死意甚堅，家屬也難以事先防範阻止自殺，對於房價損失發生並無故意，在事發後也辦理拋棄繼承。合議庭判決死者家屬免賠，全案可上訴。1020925
