屢罰不怕 男子第六度酒駕判刑六月並強制戒酒

新竹一名林姓男子已有五次酒駕前科，今年又再度酒後無照駕車被查獲，酒測值高達一點零毫克。新竹地院審理後，依公共危險罪名，判處被告六個月有期徒刑。如易科罰金，將要付出十八萬元。(彭清仁報導)

判決書中指出，新竹一名五十七歲的林姓男子，喝了半瓶米酒騎機車上路，結果被警方攔檢查獲，酒測值達一點零毫克。這也是林姓男子，從民國九十年至今，第六度酒後駕車被查獲；前五次被查獲分別被判處罰金五萬一千元、三萬元、五萬元、有期徒刑五個月，以及有期徒刑六個月。

檢警調查指出，被告林姓男子今年六月因為公共危險案件，被法官判處六個月徒刑，且必需強制送戒除酒癮三個月；只是強制戒除酒癮還未執行，被告仍不知悔改，在六月廿四日又再度酒後無照騎機車，在竹北市被警方攔檢移送。法官調查指出，被告林姓男子家境清寒，教育程度並不高，且犯後態度良好，對於第六度酒後駕車，法官還是依公共危險罪名，判處被告六個月的有期徒刑，得易科罰金，而且強制戒除酒癮三個月還是要實施，否則不給予罰金。換言之，被告喝了半瓶的米酒，但要免除牢獄之災，要付出十八萬元的代價，對被告來說也是相當沈重的負擔。
