【苦勞網】關廠工人首勝 前行仍有險

【苦勞網記者孫窮理／台北報導】關廠工人與勞動部間的訴訟，今天（3/7）出現重大突破。台北高等行政法院就5個個案，宣判關廠工人勝訴，並認定勞委會所主張當年民事上的「借款」，屬於「基於國家責任」的補償，而無論這筆補償的性質是否需要償還，都已經因為超過公法契約5年時效而消滅，這5個個案的關廠工人無須還款。宣判之後，全國關廠工人連線再度要求勞動部立即對所有關廠工人撤告。

由於公法契約的請求權時效為5年，工人在行政法院獲得勝訴，並不讓人意外。值得觀察的是，法官對於實體法律關係的認定。...（閱讀全文）
