總統未批總辭案前閣揆沒代理問題

行政院法規會主委劉文仕1日晚指出，行政院所提出的內閣總辭案，在馬總統沒批示之前，行政院長沒有代理問題，只是請辭待命。因此，行政院長江宜樺一直到閣揆交接前，仍是閣揆身分，但不能處理重大政策。

劉文仕說，在2000年，前行政院長唐飛因與前總統理念不合，請辭閣揆，在提出內閣總辭後，依憲法增修條文第3條規定，「行政院院長辭職或出缺時，在總統未任命行政院院長前，由行政院副院長暫行代理」。當時的副院長張俊雄暫行代表6天，才發布為行政院長。

劉文仕說，這次模式與唐飛模式仍有不同，是採較嚴謹的方式，即內閣總辭案在總統批示後，才有由副院長暫行代理的問題，江揆在總統未批示前，仍為閣揆身分。但唐飛當年提出內閣總辭後，就開始認定為「已請辭」，並離開行政院。
