中市一家餐廳羅姓負責人與丈夫翁姓男子協議離婚9年後，羅提告請求給付新台幣千餘萬元贍養費，台中地院認定離婚無效駁回。

羅女與翁男在2005年協議離婚，協議翁男每月給付30萬元贍養費。兩人在9年前離婚後已各自嫁娶，雙方後續經營餐廳發生競爭問題，羅女去年間提出請求翁男履行離婚協議，支付60個月贍養費共新台幣1400多萬元。

台中地院審理時，發現兩人協議離婚時，由李姓代書及李姓代書的母親當證人，但李母並不知情，且未親自簽名蓋章，而認定兩人離婚無效，駁回羅女請求，而翁男則已另提確認婚姻官司存在訴訟。

台中地院表示，法官審理發現兩人離婚由李姓代書辦理，而李姓代書已有3件辦理離婚案件，都是由李的母親擔任證人，但李母並不知情，也未親自簽字蓋章；而羅及翁兩人也未見過李母。

台中地院指出，法官將再調查雙方前婚和後婚的關係，根據民法規定，若雙方是善意且無過失辦理離婚登記，並因信賴已離婚而再婚，前婚視為無效，但是雙方贍養費等權利關係，必須重新約定或另提告主張。(中央社)
