外人在台打官司　銀行可借錢

【廖珮君／台北報導】金管會今晚宣布，在台無住所的外國人在台灣，若因訴訟需要可跟銀行辦理保證業務。

銀行局副局長張國銘解釋，有一家在台沒有據點的外商保險公司，因擔任再保人有些糾紛，但該外商保險公司在台沒有新台幣頭寸，請外銀在台子行開台幣信用狀做信用擔保。金管會認為，未來若是訴訟上，可以透過銀行做擔保。

張國銘說，目前在台無住所的外國人，跟銀行往來，授信範圍包括股票、不動產投資等，但限制需是有擔保授信。他說，因考量我國法院實務上，要求提供訴訟費用的擔保裁定，都是以台幣為主，開放銀行可做外人辦理訴訟擔保後，除保障外人在我國法院的訴訟權外，也有利我國金融市場健全發展。

他說，未來國外廠商有貿易糾紛、訴訟，有融資需求，將可以多一項工具使用。
