43 貼一下國賠法上 關於 公物管理不當國賠要件 .針對公有公共設施的設置及管理不當(國賠法第3條第1項): (1)須為公有公共設施。 (2)須公有設置或管理有欠缺。 (3)須人民的生命、身體或財產受有損害。 (4)人民受到損害與公有公共設置或管理之欠缺間具有相當因果關係。 公有物管理不當國賠採 『無過失責任主義』 所以不論是否高公局（？）有過失 怎樣怎樣他不知道有擦撞啥小 通通就是要賠你.........不管管理單位有沒有『過失』 這是法條上面的定義＆要件 其他相關請自行參閱國賠法 而且賠償單位可不是國家幫你去跟包商代位求償 這跟車險不一樣 別搞錯了.... 實務案例可以在查 不過由法條來看 的確有國賠的機率 thx 有錯感謝指教 因為三個月沒唸了XD -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 125.231.56.42
