妻販毒入獄 三審判准毒鴛鴦離婚定讞

宜蘭縣蘇澳鎮一名有毒品、傷害等前科的男子，因妻子觸犯毒品罪被判刑入獄，向法院訴請離婚。妻子則供稱她是婚後跟著丈夫一起吸毒、現在她入獄丈夫卻另結新歡要跟她離婚，所以另提返還財物的請求。最高法院審理後，判准兩夫妻離婚，男子要返還妻子十五萬元定讞。

判決書指出，民國83年結婚的林姓男子主張，妻子買賣毒品又嗑藥遭法院判刑26年，現正在服刑中，兩夫妻已分居長達十多年，難以再共營夫妻生活，所以訴請離婚。

妻子則主張，她嫁人三年後才開始跟丈夫一起吸毒，甚至替對方扛罪，丈夫當時曾甜言蜜語承諾願意照顧她一生一世，永不變心，從沒做過對不起丈夫的事，丈夫入獄時，她風雨無阻固定接見、寄錢，公婆生病也全心全意照顧。現在身繫囹圄，丈夫外面有女人所以想離婚，又將她全部錢拿走，因此請求對方返回150萬元。

二審認為，兩夫妻都是監獄與看守所的常客，婚姻難以維持，雙方均須負責，所以判准兩人離婚，此外，法院依提款紀錄，判決林姓男子必須返還妻子新台幣15多萬元。妻子不滿上訴三審，最高法院駁回上訴，全案就此確定。
