「我有睡眠性交症」　瑞典法院判性侵無罪

瑞典一名被判性侵罪成的男子，因患「睡眠性交症」(sexsomnia)而獲上訴庭推翻原判。

據英國《衛報》報導，這名26歲男子在睡夢中與一名女子性交，性侵罪成被判入獄2年。被告以自己在不知情的狀況下與女子性交，提出上訴。瑞典北部松茲瓦爾上訴庭，聽取一名主治睡眠失調的醫生意見後，指被告可能患睡眠性交症，在睡夢中不由自主地與另一人進行性交，而被告的前女友也證實醫生的說法。

上訴庭認為，被告性交時處於「睡眠、對一切亳無意識的狀態」，並沒有性交的意圖，而這種情況並不荒謬，所以推翻判他2年監禁的刑罰。睡眠性交症是睡眠失調的一種，與夢遊類似，包括在睡眠狀態下進行性交。相關研究並不多，但在醫學界和法律界仍是爭議議題。（施旖婕／綜合外電報導）
