性侵鄰居 男判12年定讞

桃園縣一名男子兩年前為逞一己私慾，竟將住在附近一名患有智能障礙的鄰居誘拐回家性侵，前前後後性侵得逞五次。最高法院依乘機性交罪，判處男子有期徒刑十二年確定。

判決書指出，蔡姓男子明知被害女子是智能障礙者，認為有機可趁，竟從民國101年2月中旬開始，在桃園縣八德市的住處性侵被害女子。直到同年4月底，被害女子返家時因神情有異被母親發現，終於揭發蔡姓男子的惡行。檢警調查，蔡姓男子在兩個半月內，涉嫌性侵被害女子達五次因而將他提起公訴。

高院審理時，蔡姓男子堅稱有獲得被害女子同意。經法院調查，認為被害女子是因為心智有缺陷，所以不知該如何反抗與拒絕，認定蔡姓男子觸犯五次乘機性交罪。審酌蔡姓男子案發後與被害母女對話過程態度輕浮，不願認錯，至今沒有取得被害人的原諒，衡量以後判處有期徒刑十二年。全案上訴三審，經最高法院駁回上訴定讞。
