酒測沒先漱口，免罰！去年一名張姓男子酒後騎車，遇到酒測，測後酒測值超標，濃度達0.21，遭罰1萬5000元，吊扣駕照，並須參加道路交通安全講習，但因警方在酒測前，未讓張姓男子漱口，因此法院裁定張姓男子免罰。

法官在審理後認為，警方在酒測前應先告知當事人酒測程序，並須詢問喝酒結束時間到酒測時間是否已滿15分鐘，若時間已滿，須馬上替當事人酒測，若沒滿則須等候15分鐘才可酒測，不過這都有個前提，就是當事人若要求漱口，警方都須答應。

但在本案中，警方並未詢問張男喝酒時間，且也沒讓張男漱口，屬程序上重大瑕疵，因此張男雖酒後騎車，但並無法判對正確的酒測值，所以法官判決張男免罰。
