中時刊李宗瑞不雅照 副總編等人判3個月

《中國時報》去年8月26日報導李宗瑞事件，於頭版刊登李宗瑞性愛影片檔截圖照片，高院今（27）日宣判，時任副總編輯楊憲村、陳賡堯，以及社會組主任王健聖、記者陳鴻偉各判刑3個月，可易科9萬元罰金，緩刑2年，緩刑期間須向公庫繳納10萬元。

台灣高等法院指出，時任副總編輯的楊憲村、陳賡堯，以及社會組主任王健聖、記者陳鴻偉，因於中國時報刊登偷拍照，已觸犯刑法妨害秘密罪章的「散布竊錄之非公開內容罪」。

高院表示，但考量此案是「一時失慮誤觸法網」，不無隱含「為所有傳播媒體而犧牲」的意涵特質，情有可原。因此由一審原判被告4人各處6月徒刑、可易科罰金，改判4人各3月徒刑、可易科罰金，並給予4人緩刑2年且須向公庫支付10萬元。

檢方指出，中時社會組記者陳鴻偉於去年8月26日報導李宗瑞不雅照事件，還從網路上下載李宗瑞偷拍的性愛照片，並以發稿系統傳回報社。經楊憲村、陳賡堯與王健聖開會後，決定刊登其中2張不雅照於隔日頭版與3版上。

檢方指出，中國時報刊登的照片雖已馬賽克處理，但仍使被害女子身體隱私部位和非公開活動曝光，造成被害人精神痛苦，依妨害秘密罪嫌起訴記者、社會組主任與副總編輯4人。台北地院一審原判處4人各6月徒刑，可易科罰金。
