「禁外食違憲」逆轉勝 影城判免罰

美麗華影城先前因為禁帶外食遭到北市府開罰，業者不服上訴，法院判定電影院禁帶外食是為了保障消費者權益，屬於憲法保障職業自由，判美麗華不用罰。

第一家因為禁帶外食被北市府開罰的戲院美麗華，這回卻在法律程序上「逆轉勝」不用罰，原來同一家電影院，八樓俱樂部有賣食物，不能外食，但其他兩層樓都有開放，卻因此被北市府判定違反禁止攜帶外食定型化契約，被連續罰六萬八萬，美麗華不服上訴，法院卻判定憲法保障人民職業自由，城業者規定不能帶外食，是為了維護其他消費者，不被食物味道或聲響干擾，屬於職業執行自由，美麗華不用被罰。

業者表示還沒收到判決書，暫時不回應，北市府則說會再循法律途徑上訴，電影院外食大戰，還要繼續打。
