眼醫2度詐保 有悔意 獲3年緩刑

台北市一家眼科診所的院長，四年前詐領健保費被抓，檢方審酌他有悔意給予緩起訴處分，結果他在緩起訴處分期間再次詐保。台北地院認為，院長兩度詐保，但他始終認罪，也曾因為義診獲得緩起訴，所以用詐欺取財罪判處院長有期徒刑六個月、可易科罰金，並宣告緩刑三年。

判決書指出，有詐領健保費記錄的林姓眼科醫師，先前獲得檢方給予的緩起訴處分確定後，又在民國98年間涉嫌利用眼科診所裡的三名醫師名義，虛構診療記錄詐領健保費40多萬元。後來因為林姓醫師與病患有醫療糾紛，經健保局調查後才發現林姓醫師再度涉嫌詐保，因此報請台北地檢署偵辦。

台北地院審理時，林姓醫師坦承犯行。法院認定他一個行為，同時觸犯三項罪名，從重以詐欺取財罪處斷。法院審酌，林姓醫師雖然在緩起訴期間再犯案，但始終坦承犯罪而且深表悔意，又曾主持義診等公益活動，衡量以後判處有期徒刑六個月、可易科罰金十八萬元，並宣告緩刑三年，緩刑期間保護管束，而且要在判決確定後一年內繳公庫80萬元，勞動服務200小時。全案可上訴。
