龍角散前代理商 兄弟爭產

〔自由時報記者項程鎮／台北報導〕知名成藥「龍角散」的前台灣代理商高平公司爆發第二代爭產糾紛，纏訟4年後，最高法院日前審結，判決范家老三范育俊及老四范文陽應將公司股權轉讓給老二范育仁，范育仁則應各給付2千多萬元給2位弟弟，全案定讞。

高平公司創辦人范木青於55年間和日商合作，獨家引進「龍角散」，生意好時，每年賺數千萬；范木青4個兒子都很優秀，老大范育材開會計師事務所，老二范育仁是日本長崎大學醫學博士，老三范育俊是留美化工博士，老四范文陽是診所醫師。

判決指出，范木青在87年11月家族會議中，將財產分贈4個兒子，4兒各得1億5千萬元；老二范育仁多得7千萬元，還負責經營高平公司並擔任董事長，其他兄弟須將公司股權移轉給老二，老二則須補貼其他兄弟。

不過，老三、老四認為分產不公平，拒交出公司股票。91年間，范木青撤銷87年的分產贈與協議，改由老三接任高平董事長；98年底范木青過世後，老二提出訴訟，主張87年分配財產贈與契約有效，兄弟對簿公堂，互提多起民、刑事訴訟。

此外，龍角散日本原廠在范木青過世後終止高平公司代理權，成立台灣龍角散公司，與老三范育俊合作。

最高法院認為范木青87年間的分產決定有效，當時范木青已將高平股票贈與4個兒子，事後無權撤銷分產決定，判決范家老三和老四須轉移股權給老二；老二應補貼老三和老四各2334萬餘元。
