凱道嗆馬案 林飛帆等人不起訴

〔自由時報記者錢利忠／台北報導〕黑色島國青年陣線成員林飛帆、陳為廷、魏揚及黃國昌等人，為抗議馬英九發動「九月政爭」，去年十月八日率眾夜占總統府前凱道高呼「毀憲亂政，馬吳江下台」，警方四度舉牌後依違反集遊法送辦，台北地檢署認為，只有警局分局長有舉牌制止權限，前三次舉牌者非分局長，昨將林飛帆等人不起訴。

林飛帆昨天得知獲不起訴之後，透過臉書PO文表示，開個記者會、拉個布條，有什麼須大費周章的移送法辦，在保障言論、集會自由及妨害秩序的權衡下，「我想檢察官選擇了對的一方」。

另外，檢方也認為抗議群眾當時停留在原處呼口號，往來人車並未受阻，只有在遭到警方制止時才「消極抵抗」，沒攻擊警方，認定警方移送林飛帆等人的罪證不足。
