鄉鎮市長出缺 女代母職將被禁止

村里長、鄉鎮市長因案停職出缺，指派同陣營或「女代母職」的情形將被禁止。內政部部務會報7日通過地方制度法修正草案，增定「相當職務的現職」人員才能代理村里長或鄉鎮市長。

內政部指出，2008年嘉義縣大林鎮長李秀美因涉及鎮長選舉賄選官司，遭高等法院判決有期徒刑3個月定讞，依公職人員選舉罷免法規定需停職處分。由於所剩任期不足兩年，縣長陳明文竟指派同派系同民進黨陣營的李秀美女兒黃貞瑜出任代理鎮長，引發地方議論。

內政部次長蕭家淇表示，為了社會觀感，新修正地方制度法明定，必須指派相當職務的現職人員才能代理，例如鄉鎮長比照簡任10職等，可指派相當職務如9職等的公務員代理。

另外，新地方制度法也增定，地方首長若因貪汙遭停職，辭職後再選上公職，仍應再停職，以杜絕選上當官，選不上被關的政治惡習。
