大葉大學少付薪水　教授獲償544萬元定讞

【劉昌松／台北報導】加州柏克萊分校機械工程博士王啟聖2004年受邀回台，到大葉大學擔任客座教授，但王不滿原本談好的年薪10萬元美金（新台幣328萬多元）、免費家庭宿舍等條件都縮水，4年3個月後離職，並打官司討薪水，最高法院判大葉大學要還王544萬多元的欠薪定讞。

大葉大學抗辯指出，根據《私校法》學校人員的聘用不得經過董事會，但當初和王談聘僱條件的是學校董事賴永川，不具代表性，而學校照一般薪資標準付錢給王啟聖沒有違約。

但台中高分院認為，賴永川當初已受校方授權委任，並非單純以學校董事身份和王啟聖談薪水，且依常理，王啟聖若無獲得相當保障，不會輕易放棄美國高薪回台任教，因此認定大葉大學應補足王啟聖短少的薪資，扣除王預支未還的實驗室費用等金額後，王可拿回544萬8774元。案經最高法院駁回上訴定讞。
