逃漏奢侈稅 恐須多倍奉還

(中央社記者吳佳穎台北13日電)國稅局表示，已掌握坊間利用「預告登記」來規避奢侈稅的案例，將全面清查類似手法的避稅行為，若查獲有漏報，不但要補稅，最重還可依所漏稅額加處3倍罰鍰。

國稅局發現，坊間有人利用「預告登記」來規避2年內不動產買賣交易要課奢侈稅的規定，研判應該是代書想出來的，呼籲民眾交易不動產，要清楚相關規定才不會因小失大。

所謂「預告登記」是為了保全不動產物權的請求權，而將權利登記，使具有對抗第三人的效力，使妨害不動產物權登記請求權所為的處分無效，保障將來登記的實現。

國稅局指出，由於特種貨物及勞務稅(奢侈稅)條例規定，房子持有期間的計算，是以完成移轉登記日起，到訂定銷售契約日為止。

利用「預告登記」逃稅者，以為先辦「預告登記」，待拖過2年課稅期，再辦移轉登記，就能規避奢侈稅；其實，2年計算要以雙方「訂定銷售契約日」為終止日，而銷售契約日國稅局都查得到資料，一旦被查獲，除補稅還要繳罰鍰，得不償失。1021013
