申訴程序未完成前　張博雅：王金平仍是立委

【王家俊／台北報導】國民黨考紀會做出撤銷立法院長王金平黨籍處分，中選會主委張博雅下午表示，國民黨還有申訴期，依法要等申訴完以後，才能將黨籍喪失證明送到中選會，目前還不能馬上撤銷（立委資格），「在申訴程序走完以前，王金平仍具有立委資格。」官員透露，截至傍晚為止，中選會仍未收到國民黨送來王金平的黨籍喪失證明。

依照《公職人員選罷法》第73條第2項，全國不分區立委在就職後喪失其所屬政黨黨籍者，至喪失黨籍之日起，喪失其資格，由中央選舉委員會函請立法院予以註銷。立法委員之遞補，應自立法院註銷名籍公函送達之日起15日內，由中選會公告遞補名單。

張博雅表示，已就上述法條詢問幕僚，「撤銷（黨籍）資格在中選會或立法院，這部分還要研究。」她強調，中選會收到國民黨的黨籍喪失證明，會立刻函轉立法院，但在立法院回文、將註銷名籍公函送達中選會之前，相關遞補立委程序，仍有爭議。
