前總統陳水扁保外就醫案，前副總統呂秀蓮日前表示，若24日前未能保外就醫，將展開絕食。對此，國民黨立委廖正井今（18）日上午在立法院質詢法務部矯正署時要求，呂秀蓮都要絕食了，為什麼不好人做到底、不趕快開會，一定要「把事情鬧這麼大」？廖正井更痛罵矯正署長吳憲璋「豬腦袋」。

立法院司法委員會上午審查法務部矯正機關預算，國民黨司法委員會召委廖正井質詢時，對吳憲璋詢問有關陳水扁保外就醫一事。吳憲璋指出，「尊重醫療小組鑑定結果」。

廖正井批評，吳憲璋這樣的回答根本就是官僚。他說，包括行政院長毛治國、法務部長羅瑩雪針對阿扁保外就醫案的方向都已決定，就是要放人，法務部腦袋卻這麼僵硬，「一定要等人家抗議，才心不甘情不願放人，這樣好看嗎」？廖正井認為，應該立即開會，在24號之前，法務部就要決定，否則也要去跟呂秀蓮溝通。

對於廖正井的質詢，法務部次長吳陳鐶表示，扁案要尊重專業，會嚴肅、慎重處理這個案子，也會加強與各界溝通。然而，針對何時會釋放扁吳陳鐶也無法承諾，廖正井說，扁案若不積極處理，「他要把法務部預算刪光」。
