食安危險犯入法 有危害之虞即可開罰

立院今日三讀「食品安全衛生管理法」，將「危險犯」列入罰則，未來對於有足以危害健康之虞，且情節重大的黑心食品業者，不必等到造成傷害，即可開罰；罰則除提高有期徒刑為7年外，也增加併科罰金上限至8,000萬元。

推動修法的立委管碧玲指出，消費者通常少量消費，根本無法直接證明不法食品或違法食品所造成的後果，有鑑於消費者處於如此弱勢的事實，她在去年即在「食品安全衛生管理法」中除了「行為犯」、「結果犯」之外，增加「危險犯」的刑罰；

管碧玲說，她在今年修法時再度提出，朝野協商確定了她的主張，將「危險犯」納入為重罰的對象，只要「情節重大足以危害人體健康之虞者」處罰和「結果犯」ㄧ樣重。
