有智能障礙和身障？男約少女嘿咻12次　家屬質疑裝的

一名領有身心障礙手冊的男子，日前透過交友網站，結識一名還就讀國二的少女，並且還乘機約砲嘿咻12次。事後少女的家長發現後，怒控男子性侵，法官審理後認定男子犯後態度良好且有悔意，考量其身心狀況輕判他6個月徒刑，但家屬無法接受，將提上訴提民事求償。

根據檢警調查，該名男子日前透過交友網站，結識一名未滿16歲的國二少女，雙方網路交往一段時間後，男子陸續約出少女，先後在住處和汽車旅館發生性關係，次數至少12次。事後少女的父母發現有異，詢問後得知女兒和對方發生關係，憤而怒控對方性侵，要求法官重判。

男子在調查期間，拿出醫院出示的診斷證明和殘障手冊，稱說自己有智能障礙，但因為沒和被害人家屬達成和解，遭到檢方起訴。根據《自由時報》報導，法官認為少女和男子發生關係並非出於逼迫，並認定2人某種程度有男女朋友的關係，但因少女未滿16歲，2人嘿咻12次，判處合併執行6個月徒刑。

少女家屬無法接受，他們認為男子有能力上網，並誘拐女兒到賓館，不像有智能障礙者會做出的事情，因此認為鑑定報告有問題。
