台德簽協議 人犯可回國服刑

德國在台協會處長紀克禮（Dr. Michael Zickerick）昨日正式簽署台德「移交受刑人及合作執行刑罰協議」，目前在德服刑的20名國人及在台服刑的7名德籍人士，均可申請返回母國服刑；法務部表示，此協議為台灣與歐盟國家簽署的第一個司法合作協議，有助於台德兩國移交人犯，移交人犯不僅符合人道精神，亦能充分發揮教化功能。

德國自96年起便與我國洽商移交受刑人返國執行的可行性，直至前法務部長曾勇夫去年訪問德國終與德國司法部達成共識；我駐德代表陳華玉10月23日先於德國柏林簽署協議，紀克禮昨日則於法務部完成異地簽署，由外交部常次史亞平及法務部政次吳陳鐶在場見證。

紀克禮簽署後笑稱，簽署協議別具意義，他要把簽名的筆留下來作紀念。

吳陳鐶則說，世界各國紛紛與其他國家簽訂協議或條約，讓受刑人回到母國服刑，而受刑人移交後，刑罰基本上不會改變，但受刑人回母國服刑可收較好的教化效果。
