誣指小叔殺丈夫 婦人判刑2月

（中央社記者吳哲豪彰化1日電）紀姓婦人指小叔殺害丈夫要求開棺驗屍，檢方不起訴，聲請再議也被駁回，婦人小叔認為婦人誣告，法官判婦人有期徒刑2個月。

根據彰化地方法院今天公布的判決書，民國86年，紀姓婦人不滿丈夫騷擾，到親戚家過夜，回到家發現丈夫陳屍在自家後方的空地，檢警相驗認為男子為意外死亡，無他殺嫌疑。

15年後，紀姓婦人向警方報案指稱，丈夫死亡前1天曾和小叔吵架，隔天就陳屍空地，懷疑是小叔殺了丈夫，不過檢方調查後處以不起訴處分，但婦人不服聲請再議，也遭高檢署駁回。

紀姓婦人的小叔不滿，控告婦人誣告，紀婦向法官辯稱，丈夫曾託夢給她，夢中丈夫拿石塊敲小叔家鐵門，小叔開門後就把丈夫壓在地上，然後又有2、3個人出現幫忙小叔把丈夫壓在地上並悶死，她要求開棺驗屍。

法官認為，當年檢警未在婦人丈夫身上找到可疑傷勢，婦人也未提疑義，認為是紀姓婦人和小叔因為交惡，藉詞託夢報復，婦人浪費國家司法資源，但顧及雙方住在隔壁，因而判處有期徒刑2個月。1021001
