假處分案藍提抗告 高院最快1天內裁定

針對立法院長王金平假處分案，國民黨委任律師團於今天下午5時39分，正式向台北高等法院提出抗告。高院已以「最速件」進行處理，最快1天內就會裁定是否抗告成功。

國民黨委任律師陳明接受訪問時，提出2點抗告主要理由。首先，他指出，根據高院裁定與日本判決，政黨對於黨員的處分是屬於黨內自治事項，普通法院無權對其進行審判。

另外，有關王金平的立委資格，陳明表示，在中選會將註銷黨籍公文送至立法院時，王金平就已經喪失立委資格，儘管立法院尚未註銷王金平的名籍，但註銷的程序「屬於立院內部人事作業程序」，對於王金平喪失立委資格一事，沒有任何影響，因此也沒有任何假處分的必要。

台北高等法院表示，由於本案受到全國各界矚目，將會以最速件處理，視雙方的事證準備程度而定，最快1天之內就會作出裁定。
