【動新聞】法院無權審王案　國民黨提抗告

【綜合報導】針對王金平提出假處分案，國民黨律師重整旗鼓，這次除了原先的委任律師陳明之外，還找來律師李永裕，和曾幫友寄隆輝打官司的林合民，要力抗王金平七人律師團。

國民黨律師陳明表示，政黨對黨員處分，屬於政黨內部它的自治事項，他們主張普通法院沒有審判權。陳明表示律師團已經到日本最高審判所判決，要給高等法院參考，另外，對於王金平的立法委員資格，他們認為當立法院收到中選會公文時，已經喪失。所以如果沒有立法委員身分時，也沒有必要假處分。而立法院長王金平對於國民黨提抗告，只有表示尊重。
