攤販納入勞基法 勞動部研議

（中央社記者許秩維台北11日電）勞動部今天表示，近期將邀經濟部等單位研議，將攤販等未分類餐飲業的受僱勞工納入勞基法，保障工時和休假等權益，預估適用對象近萬人。

現行攤販、夜市等餐飲業商家的受僱勞工未能適用勞動基準法，工時、薪水等勞動條件全靠勞資雙方協議。

勞動部表示，未受勞基法保障的職業類別將逐年檢討，而攤販流動性高，勞動條件權益過去全靠勞雇協議，勞工若被解聘也沒有資遣費，工時、休假、加班費都沒有保障，因此今年將檢討「未分類其他餐飲業」，近期將邀經濟部等單位研議。

勞動部表示，根據初步資料，小吃、飲料攤、外燴等攤販的受僱勞工約近萬人，未來若能適用勞基法，月薪不得低於基本工資，工時應按照勞基法規定，雇主每月需提撥工資6%的勞退金到勞工個人專戶，希望最快今年能公告、明年上路。1040111
